General Terms & Conditions
(T&C – Detailed Version for Online Shop)
An offering by fairDogs GmbH, Bottmingen and Claudia Lang – Dog Trainer
(Hund aufs Herz (Heart to Hound) – explanation once; thereafter “Hund aufs Herz”)
1. Scope
These Terms & Conditions govern the rights and obligations between fairDogs GmbH (Hund aufs Herz) and you as a client or participant. They apply to all services, both online and in person, including consultations, personality tests, case assessments, individual training, group courses, walks and seminars. Any additional agreements are only valid if confirmed in writing.
2. Contract Formation & Registration

Your registration (online, by phone, or in writing) is binding.

A contract is formed once we confirm your booking.

Class sizes are limited. Registrations are processed in the order in which they are received.

We reserve the right to decline registrations without giving reasons.

Registration obliges you to pay the full course fee.
-
Participation is only guaranteed once payment has been received.
3. Payment, Packages & Credits

All services must be paid in full before the start of the course or training.

If payment is missing or late, we may exclude you from participation.

Packages are personal, non-transferable, and valid for 1 year from the date of purchase. After that they expire.

As a courtesy, we may grant an extension if you pay the price difference to the current rates plus a processing fee of CHF 20. The extended package will then be valid for one additional year.

Referral benefits: New clients receive a 5% discount on their first invoice, and you receive the same credit on your next booking.

Credits are valid for 2 years, non-transferable, and cannot be exchanged for cash. They may only be used for services provided by Hund aufs Herz.
4. Participation Requirements

You are responsible for yourself and your dog.

Your dog must be covered by liability insurance.
-
For group classes and walks: your dog must be healthy, vaccinated (as legally required), and socially compatible.

For case histories and individual training sessions, sick or unvaccinated dogs may participate if appropriate.

Female dogs in heat are generally excluded from group classes and walks. In justified cases, the trainer may grant an exception in consultation with other participants.

For online services, you are responsible for being on time and technically reachable.

We reserve the right to exclude you from a course for safety reasons if your dog is uncontrollable, endangers others, or disrupts the session. No refund will be provided.

The trainer may exclude participants who violate applicable laws or animal welfare regulations at any time.

Participants must follow all instructions given by the trainer.
5. Personality Test
The fairDogs personality test was developed by Claudia Lang. It identifies tendencies and traits of both humans and dogs and supports you in recognising strengths and understanding potential conflicts.
The entire personality test for humans and dogs—including all questions, structures, scoring systems, typologies, and interpretation logic—is protected by copyright.
Reproduction, distribution, or any use beyond private, personal application is not permitted without written permission from Claudia Lang and may incur fees.
The data collected in the test is used exclusively to generate the individual evaluation. Selected information may be used in fully anonymised form for internal statistical analysis, research, and further development of the test—without any link to identifiable persons or dogs.
The test is considered started once the online form is opened or accessed.
6. Assessments & Observations
Our case histories, personality tests, and training plans are based on professional experience and created with the utmost care. We rely on complete and truthful information from dog owners and on test answers being filled out correctly. All assessments reflect situational observations and professional judgement.
We cannot guarantee future behaviour or any specific training outcome. Our work is not a substitute for veterinary diagnosis. Responsibility for further steps lies with the dog owner.
The personality test does not replace veterinary, therapeutic, or legal advice and is considered part of our case history (anamnesis) process.
7. Cancellations, Refunds & Rebookings
Individual training sessions:
• Cancellation up to 2 business days in advance: free of charge
• Later cancellations: full fee applies
Group courses & walks:
• Cancellation up to 14 days before start: free of charge
• Cancellation up to 7 days before start: 50%
• Later cancellations or no-shows: full fee applies
Courses already started cannot be refunded or prorated.
Rebookings:
No entitlement. As a courtesy, rebooking may be granted with a CHF 20 processing fee.
Cancellations by us:

We may cancel or reschedule events due to low participation or organisational reasons.

Fees already paid will be fully refunded. Further claims (e.g., damages) are excluded.

We may adjust content, structure, or trainers without this entitling participants to withdraw.

Unused lessons from packages expire after the validity period. Refunds are excluded.
Digital products (e.g. personality tests):
No refunds once usage has begun.
The test counts as "used" once the online form is opened.
8. Copyright & Trademark Protection
All course content, handouts, presentations, documents, website text, photos, personality tests, phone calls, online sessions, and video calls are protected by copyright.

Copying, sharing, or publishing any content without written permission from fairDogs/Claudia Lang is prohibited.

Recording online trainings or video calls is only permitted with explicit written approval.
This also applies to notes, screenshots, and audio recordings. -
Brand names, logos, and concepts of fairDogs may not be used without prior written permission.
9. Photos & Videos
We may take photos or videos during courses or events.
These may be used for our own promotion (website, social media) with your consent.

Images where you or your dog are clearly recognisable will only be used with your explicit approval.

For group photos or images taken from behind, consent is considered granted unless you object in advance.

If you later withdraw your consent, you bear the cost of removing the content.
Please note that online content may remain stored or visible even after deletion. -
Photos/videos shared in internal groups (e.g., WhatsApp) may not be used or published privately or publicly.

Participants may only take photos or videos with the explicit permission of the responsible trainer, and only if all identifiable persons and their dogs have agreed as well.
10. Reporting Obligation
As a certified dog trainer, I am legally obligated under the Swiss Animal Welfare Ordinance to report relevant observations (e.g., animal cruelty or dangerous behaviour) to the authorities.
11. Waste Disposal (Robidog Requirement)
You are required to pick up after your dog and dispose of waste in designated Robidog bins—including during courses held in public spaces.
12. Liability

You are responsible for your dog and for any damage your dog causes.

We are liable only for intent or gross negligence.
-
We assume no liability for injuries, damage, or incidents occurring during our services.

No compensation is provided for theft, loss, or damage to personal belongings during events.

Participation is at your own risk.
-
Dog owners are fully liable for damage caused by their dog—even if they are not present during the event.
-
Participants must have valid dog liability insurance and present proof upon request.
13. Physical Products (Shipping & Delivery)
Shipping:
Physical products (e.g., calendars, photo products) are shipped by post after payment.
Shipping costs are shown during checkout.
Prices & VAT:
All prices are in Swiss francs (CHF) and include VAT where applicable.
Right of return:
Personalised or custom-made products are non-returnable.
Other physical products may be returned within 14 days in unused, undamaged condition at your own cost.
Opened or damaged items cannot be returned.
All returns must be announced in writing in advance. Unannounced returns cannot be accepted.
Warranty:
The statutory warranty applies.
Obvious defects must be reported in writing within 7 days.
Transport damage must be claimed with the shipping provider.
Retention of title:
Goods remain the property of fairDogs GmbH until paid in full.
14. Severability Clause
If any part of these T&C becomes invalid, the remaining provisions shall remain unaffected. The invalid clause will be replaced by one that comes closest to its intended economic purpose.
15. Amendments
We may update these T&C at any time. The current version is always available at hundaufsherz.ch.
16. Validity
These T&C are valid from 8 September 2025.
The version published on the website is authoritative.
In case of discrepancies between the short and detailed version, the detailed version prevails.
17. Applicable Law & Jurisdiction
Swiss law applies.
